These Terms & Conditions (“Terms”) govern your use of the weed-control services, website, and online client portal provided by Arizona Weed Control Services LLC (“Arizona Weed Control,” “we,” “us,” or “our”). By requesting an estimate, scheduling service, creating a portal account, or otherwise using our services, you agree to these Terms. Please read them carefully.
1. Services
Arizona Weed Control provides weed-control and vegetation-management services for residential, commercial, industrial, HOA, and property-management customers across the Phoenix and Tucson metro areas, including pre-emergent and post-emergent herbicide applications, desert rock and gravel treatments, and brush and fire-risk vegetation control. We also provide an online client portal where you can view your service history, treatments, and billing and request service. The specific work to be performed, frequency, and price are described in your estimate, service program, or invoice.
2. Estimates & Scheduling
Estimates are provided free of charge and are valid for the period stated on the estimate. Estimates are based on the property conditions described to us or observed at the time of the estimate; actual pricing may be adjusted if conditions differ materially (for example, property size, weed density, or access). Scheduling is subject to weather, crew availability, and route logistics. We will make reasonable efforts to service your property on or near the scheduled date and to notify you of significant changes.
3. Service Programs & Recurring Service
We offer one-time, monthly, quarterly, and annual service programs. If you enroll in a recurring program, you authorize us to automatically schedule visits and, where you have provided a payment method, to charge for each completed service according to the program terms. Recurring programs continue until cancelled. You may cancel a recurring program at any time by contacting us using the information below; cancellation takes effect for services not yet performed and does not entitle you to a refund for services already completed.
4. Pricing, Billing & Payment
Prices are as stated in your estimate, program, or invoice. Payment is due as indicated on your invoice unless other arrangements are made in writing. We accept the payment methods identified at the time of service, which may include card payments, installment billing on qualifying programs, and the electronic payment options we make available. You are responsible for all charges incurred under your account. Amounts not paid when due may be subject to suspension of service and reasonable collection costs to the extent permitted by law.
5. Cancellation & Rescheduling
You may reschedule or cancel an upcoming service by contacting us in advance. We may reschedule service due to weather, safety, or operational conditions. If we are unable to complete service because the property is inaccessible (for example, a locked gate or an obstructed area) or because of conditions outside our control, a trip or rescheduling charge may apply.
6. Service Guarantee & Re-Treatment
We stand behind our work. If weeds return within the period covered by your service or program, we will return to re-treat the affected area at no additional charge, subject to the terms of your specific service. This guarantee does not cover new growth caused by conditions outside our control, including significant rainfall or irrigation, new seed introduction, or areas outside the treated zone. Herbicide performance depends on many factors; while we use professional products and methods, we do not guarantee that any property will remain permanently free of all weeds.
7. Property Access & Your Responsibilities
You agree to:
- Provide safe and reasonable access to the areas to be treated on the scheduled date.
- Secure pets and inform us of pets, children’s play areas, gardens, sensitive plants, wells, ponds, or other features requiring special care.
- Keep people and pets off treated areas until sprays have dried or for any re-entry period we specify.
- Disclose known hazards on the property (for example, aggressive animals, unmarked utilities, or unstable terrain).
- Ensure you are the property owner or are authorized to request service for the property.
8. Herbicide Applications & Safety
Herbicide and vegetation-management products are applied by or under the supervision of a licensed applicator in accordance with the product label and applicable Arizona regulations. Product labels are the law; we follow label directions for rates, conditions, and re-entry intervals. Results vary based on weed species, weather, soil, timing, and property conditions. You acknowledge that weed control is a treatment service and not a guarantee of any particular outcome.
9. Client Portal Accounts
The client portal is provided for your convenience to view treatments, billing, and service history and to request service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information, to keep it current, and to notify us of any unauthorized use. We may suspend or terminate portal access for misuse, security reasons, or violation of these Terms. Portal information is provided for convenience and the applicable estimate, program, or invoice controls in the event of a discrepancy.
10. Communications & Text-Message (SMS) Consent
With your consent, we may contact you by phone call, text message (SMS), and email regarding your estimates, appointments, service reminders, billing, and — where you have opted in — marketing and special offers. Message frequency varies. Message and data rates may apply. You can opt out of text messages at any time by replying STOP, and reply HELP for help. You can opt out of marketing emails using the unsubscribe link in any such email. Consent to receive automated or marketing messages is not a condition of purchasing any service. 11. Disclaimer of Warranties
Except for any express guarantee stated in these Terms or your service agreement, our services, website, and portal are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
12. Limitation of Liability
To the fullest extent permitted by law, Arizona Weed Control Services LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, arising out of or related to your use of our services, website, or portal. Our total liability for any claim arising out of or relating to the services will not exceed the amount you paid us for the specific service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnification
You agree to indemnify and hold harmless Arizona Weed Control Services LLC and its owners, employees, and agents from any claims, damages, or expenses arising out of your breach of these Terms, your misuse of the services or portal, or your failure to disclose property conditions or hazards as required above.
14. Intellectual Property
The website, portal, and their content (excluding your own data) are owned by Arizona Weed Control Services LLC or its licensors and are protected by applicable law. You may not copy, modify, distribute, or create derivative works from them except as permitted by these Terms.
15. Third-Party Services
We use trusted third-party providers to operate our business and portal (for example, payment processing, call handling, mapping, email delivery, and hosting). Your use of features that rely on those providers may be subject to their terms. We are not responsible for the acts or omissions of third-party providers beyond our reasonable control.
16. Governing Law & Venue
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or our services will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction, except where a different venue is required by law.
17. Changes to These Terms
We may update these Terms from time to time. The “Effective date” above indicates when the current version took effect. Changes are effective when posted. Your continued use of our services or portal after changes are posted constitutes acceptance of the updated Terms.
